A Thai divorce does not change a mainland Chinese spouse's status in China automatically. A Thai court judgment can be recognised by an intermediate people's court in China, and the documents must first be legalised in Thailand and by a Chinese mission until Thailand's Apostille membership begins.
Is a Thai divorce valid in mainland China?
It becomes effective in China once a Chinese court recognises it. China and Thailand have a bilateral agreement on judicial assistance in civil and commercial matters, in force since 1997, but it contains no clause on recognising court judgments.
Recognition therefore follows the Supreme People's Court's Provisions on Chinese citizens applying for recognition of foreign divorce judgments (1991, amended 2020). The Court's interpretation of the Civil Procedure Law also makes an exception for divorce judgments, which can be recognised even without a treaty or reciprocity.
Recognition covers the divorce itself. Article 2 of the Provisions excludes the parts of a foreign judgment on property division, maintenance and child custody.
Which Chinese court handles recognition, and what does it check?
The intermediate people's court where the applicant is domiciled or habitually resident hears the application. An applicant living abroad applies to the court of their last domicile in China.
- A written application with the original Thai judgment and a certified Chinese translation (Article 3)
- Proof that the judgment is final and effective
- Notarisation and authentication of foreign documents, or the treaty equivalent (Article 10)
- Where the Chinese spouse did not take part in the Thai case, proof that the Thai court lawfully summoned them
Under Article 12, the court refuses recognition if the judgment is not yet effective, the Thai court lacked jurisdiction, an absent respondent was not lawfully summoned, a Chinese court is handling or has decided a divorce between the same parties, or the judgment conflicts with basic principles of Chinese law or public interest.
If an application is withdrawn or dismissed, the Provisions still allow a divorce case to be filed in China.
What about an amphur divorce at a Thai district office?
This is the uncertain area. The Supreme People's Court's Provisions are written for divorce judgments of foreign courts, and the published rules do not clearly address a divorce registered by a foreign administrative office.
If the Chinese spouse will need to prove the divorce in China, for example to remarry, get advice from a mainland lawyer before choosing an amphur divorce. A Thai court judgment fits China's recognition procedure most clearly.
| Route | Thailand | Mainland China |
|---|---|---|
| Thai amphur divorce | Effective on registration; marriage must be registered under Thai law | Recognition path not clearly addressed in published rules |
| Thai court divorce | Effective when final, then registered at a district office | Recognition by an intermediate people's court |
| Divorce in China | Recorded in Thailand through a family status registration (Kor Ror 22) | Effective directly; consent divorce at a marriage registry has a 30-day cooling-off period (Civil Code, Article 1077) |
How do you legalise Thai divorce documents for China?
Thai public documents for use in China currently go through a two-step legalisation chain.
- Obtain certified copies of the judgment and certificate of finality, or the divorce certificate, and the district office registration.
- Have the documents translated into English, which the Chinese visa application service in Thailand accepts once the Thai Ministry of Foreign Affairs has certified it.
- Have the documents and translations certified by Thailand's Department of Consular Affairs; the fee is charged per stamp.
- Submit them for consular legalisation by the Chinese Embassy or a Chinese consulate in Thailand, through its application service.
- Prepare a Chinese translation certified as accurate for the court application.
China has applied the Apostille Convention since 7 November 2023, and Thailand joins on 28 February 2027. After that date, an apostille should replace step 4, unless the rules change, so check before you begin.
Updating marital status and remarrying in China
A recognition ruling gives the Thai judgment legal effect in China. That ruling, together with the legalised Thai documents, is what the Chinese spouse will rely on with Chinese authorities.
The Thai side has its own step. If you divorced in China instead, the Thai spouse records it at a Thai district office as a family status registration after legalisation and Thai translation.
Frequently asked questions
Can the non-Chinese spouse apply for recognition in China?
Yes, in principle. A 2000 Supreme People's Court rule states that courts should accept an application by a foreign citizen whose former spouse is a Chinese citizen.
Will recognition also cover our property and children?
No. Those parts are excluded from this procedure. Property in China and arrangements for children may need separate proceedings or agreements there.
We married in China. Can we divorce at an amphur in Thailand?
Usually not, because the amphur procedure is for marriages registered under Thai law. A Thai court case or a divorce in China are the usual options.
My spouse in China never received the Thai court papers. What happens?
A Chinese court will refuse recognition if an absent respondent was not lawfully summoned. Proper service through official channels is essential when the defendant lives in China.
Where should you start?
Decide early where the divorce must be recognised. If China matters, plan for a Thai court case with proper service, or a divorce in China, rather than discovering the problem later.
A Thai family lawyer can prepare a judgment and finality documents that match the Chinese checklist, while a mainland lawyer handles the recognition filing.
