A Thai amphur divorce between a Japanese husband and a Thai wife takes effect in Thailand when it is registered, but Japan's family register (koseki) is not updated automatically. The Japanese spouse must report it, within three months, to a Japanese embassy, consulate or municipal office.
Which divorce route fits a Japanese–Thai couple?
There are three realistic routes, and the right one depends on where you live and where the marriage was registered.
| Route | How it works | Then you must |
|---|---|---|
| Thai amphur divorce | Both attend a Thai district office with two witnesses and sign a written agreement | Report it to Japan within three months |
| Japanese consent divorce (kyogi rikon) | A divorce form signed by both spouses and two adult witnesses is filed with a Japanese office | Record it in Thailand through a family status registration (Kor Ror 22) |
| Court divorce in Thailand or Japan | Needed when one spouse refuses or terms cannot be agreed | Report or record the judgment in the other country |
Which law governs matters too. Under Article 27 of Japan's Act on General Rules for Application of Laws, Japanese law applies when one spouse is a Japanese national habitually resident in Japan. Otherwise the law of a common habitual residence applies, which for a couple living in Thailand usually means Thai law.
For that reason, a Japanese-style consent divorce may not be available to a couple who both live in Thailand. Ask the Japanese embassy or consulate before relying on it.
How do you report a Thai divorce to the Japanese family register?
Article 41 of Japan's Family Register Act requires a Japanese national abroad who completes a status act under local law to submit a copy of the certificate within three months.
- Register the divorce at a Thai district office and collect the divorce certificate (Kor Ror 7), the register entry (Kor Ror 6) and the signed divorce agreement.
- Prepare Japanese translations of these documents, including who will exercise parental power over each child.
- Complete the Japanese divorce report form.
- Submit it to the Japanese embassy or consulate in Thailand, or send it to the municipal office of the registered domicile or address in Japan.
- Check later that the koseki shows the divorce and the parental authority details correctly.
For a Thai court divorce, the deadline is shorter. Article 77 of the Family Register Act applies the court-judgment rule, and municipal guidance states 10 days from the date the judgment became final for a court divorce finalised abroad. Bring a copy of the judgment and proof of finality.
A late report is still accepted in practice, but consular guidance asks for a written explanation of the delay. Do not let it slide.
Japanese consent divorce vs Thai amphur divorce: what is different?
Both are divorces by agreement, but the safeguards differ.
- Thai amphur divorce: both spouses appear before the registrar with two witnesses, and the written agreement must say who exercises parental power over each child (Civil and Commercial Code, Section 1520).
- Japanese consent divorce: the form needs the signatures of both spouses and two adult witnesses (Civil Code, Articles 739 and 764). It can be mailed or handed in by another person, so no official sees both spouses together.
- Parental authority: since Japan's reformed Article 819 of the Civil Code, divorcing parents may choose joint or sole parental authority. Thai law records the arrangement in the divorce agreement.
If you fear your spouse might file a Japanese divorce form without your real consent, Japan has a procedure to ask the municipal office not to accept a divorce notification. It is generally filed in person, in Japanese, at a municipal office in Japan, so plan it before any dispute escalates.
How is a Japanese divorce recorded in Thailand?
If you divorce in Japan, the Thai spouse does not register a second divorce. She records the Japanese divorce at a Thai district office as a family status registration (Kor Ror 22).
- Obtain the koseki extract, or a certificate of acceptance of the divorce notification, from the Japanese office.
- Translate it into English, then have it certified by a Japanese notary, the Legal Affairs Bureau and the Japanese Ministry of Foreign Affairs.
- Translate the certified documents into Thai and have them certified by the Thai embassy or consulate in Japan.
- Have them certified by Thailand's Department of Consular Affairs and file them at a district office in Thailand.
A Thai consulate in Japan can prepare a power of attorney if the Thai spouse cannot travel home to do this.
What about children and property?
In a Thai divorce, the agreement settles parental power, child support and property. Under Section 1533 of the Civil and Commercial Code, marital property is divided equally unless you agree otherwise.
Where Japanese law governs a consent divorce, property division can be agreed later, but a court application must be made within five years of the divorce (Civil Code, Article 768). Settle the main terms in writing at the time.
Frequently asked questions
Do I need to travel to Japan to report the divorce?
No. A divorce finalised abroad can be reported at the Japanese embassy or consulate in that country, or sent to the municipal office in Japan.
Our marriage was registered only in Japan. Can we divorce at an amphur?
Often not. The amphur procedure is designed for marriages registered under Thai law. Ask the district office first, or consider a Japanese divorce followed by a Kor Ror 22 record, or a court case.
Which date is the divorce date in Japan?
For a Thai amphur divorce, the divorce took effect on the Thai registration date. The report records that date rather than creating a new divorce.
Can a Thai court decide joint custody under Japanese law?
A Thai court applies Thai procedure and considers the child's best interests. Whether Japanese rules on parental authority matter depends on the applicable law, so raise it with your lawyer early.
Where should you start?
Confirm where your marriage was registered and where each of you habitually lives. Then choose the route that both countries will accept and diary the reporting deadline.
Prepare the divorce agreement so it reads clearly in both systems, especially on parental authority. A Thai family lawyer can draft it and check the documents before you sign.
