Divorce Lawyer Thailand: 7 Checks Before You Hire One

Choose a Thai divorce lawyer who is licensed by the Lawyers Council of Thailand, has handled cases with foreign spouses, explains your options clearly in English and gives you a written fee proposal. Only a licensed lawyer can appear for you in a Thai court.

Who can handle a divorce case in a Thai court?

Under the Lawyers Act B.E. 2528, a lawyer is a person registered and licensed by the Lawyers Council of Thailand, and Thai nationality is one of the licensing requirements.

A lawyer from your home country can advise you on that country's law, but cannot represent you in a Thai courtroom. In practice, cross-border cases often need both, working together.

You do not need a lawyer to register an agreed divorce at a district office. Many foreigners still use one to draft the divorce agreement, because that document settles children and property.

What are the 7 checks before you hire a Thai divorce lawyer?

  1. Licence: ask for the lawyer's licence number and the name of the lawyer who will actually sign court documents, and confirm the registration with the Lawyers Council.
  2. Cross-border experience: ask how many cases they have handled with a foreign spouse, service abroad or proof of foreign law.
  3. Foreign law: a Thai court grants a divorce to a mixed couple only if both national laws allow it (Conflict of Laws Act B.E. 2481, Section 27). Ask how they will prove your home law.
  4. Language: who will write to you in English, and will key court documents be translated for you?
  5. Conflict of interest: has the firm advised your spouse or her family before?
  6. Plan and timeline: ask for a written outline of steps, likely hearings and what could cause delay.
  7. Fees in writing: a signed engagement letter showing what is included and what is charged separately.

How do I check a Thai lawyer's licence?

Ask to see the lawyer's licence card and note the licence number. Then contact the Lawyers Council of Thailand, which maintains the register of lawyers, to confirm the person is listed and the licence is current.

Be careful with "legal consultants" or agencies that do not name a licensed lawyer. Paperwork help is not the same as court representation.

Can a Thai lawyer run my case while I live abroad?

For a court case, mostly yes. You appoint the lawyer by a court power of attorney, and a document signed abroad usually needs to be notarised and legalised, for example at a Thai embassy or consulate.

  • You may still need to give evidence; ask early whether the court will require you in person.
  • An amphur divorce is different: each spouse signs in person, but you can sign at a Thai embassy while your spouse signs in Thailand.
  • Agree how you will approve settlement offers quickly across time zones.

How do Thai divorce lawyers charge?

Fee structures vary, and none is right for every case. What matters is that you understand it.

StructureHow it worksAsk about
Fixed fee per stageA set fee for drafting, filing, trial or appealWhat ends a stage, and the fee if the case settles early
Retainer plus timeA deposit, then time charged against itRates, billing frequency and a budget cap
Separate disbursementsCourt fees, translation, legalisation, service abroadAn estimate and receipts for each item

Costs rise with a contested case, property disputes, children's issues, service abroad and appeals. Ask for a written estimate per stage instead of one total figure.

Walk away from anyone who guarantees a result, promises a divorce "without your spouse knowing", asks you to sign blank documents, or suggests hiding assets or giving false information. No honest lawyer can promise how a judge will decide.

Frequently asked questions

Can one lawyer act for both of us in an agreed divorce?

It is safer for each spouse to have independent advice, because your interests on children and property differ. At minimum, each of you should understand the agreement before signing.

Will the court proceedings be in English?

No. Under Section 46 of the Civil Procedure Code, proceedings are in Thai, the court can order certified Thai translations of foreign-language documents, and a party who does not understand Thai must arrange an interpreter. Your lawyer should plan both before hearings.

Is the first consultation free?

Practice varies between firms. Ask before the meeting, and bring documents so the time is used well.

Can a law firm in my home country handle my Thai divorce?

It can advise you and coordinate, especially on your home law and on recognising the Thai divorce later. A licensed Thai lawyer must still draft the Thai court documents and appear in the Thai court.

What should I bring to the first meeting?

Bring your marriage certificate, passports, children's birth certificates, a list of assets and debts in each country, and any messages or letters about the separation. A short written timeline saves time and fees.

Can I change lawyers mid-case?

Yes. You can appoint a new lawyer, but settle the handover of files and any outstanding fees in writing to avoid delays.

Where should you start?

Prepare a one-page summary: marriage details, children, assets in each country and what you want. Send it to two or three licensed family lawyers and compare how clearly they answer.

Choose the lawyer whose plan and fee proposal you understand best. Clarity at the start usually means fewer surprises later.
